Welcome to Shiny, the ultimate app for trading card enthusiasts! Whether you're a seasoned collector with a vault of rare finds or just starting to explore the world of trading cards, Shiny is your go-to tool for tracking and researching your favorite collectibles. We know that the thrill of the hunt is exciting, and we're here to make that experience seamless and fun.

Shiny is owned and operated by Shiny Cardboard LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Shiny mobile application ("App"), website ("Site"), and all related services. By using Shiny, you agree to these Terms. If you don't agree, please don't use Shiny.

Who Can Use Shiny

Shiny is available globally to users who are 13 years of age or older. By using the App, you confirm that you meet this age requirement and have the legal capacity to agree to these Terms. If you're under 18, you need parental or guardian permission to use Shiny and all services provided by Shiny Cardboard LLC.

What Shiny Does

Shiny gives you a set of tools designed to enhance your trading card experience, including:

• Card Tracking - Digitally log and manage your physical trading card collections, keeping track of card details, conditions, and values.
• Market Data & Research - Access real-time and historical market data to monitor price trends, view card statistics, and make informed decisions.
• Cross-Device Access - Create and access your Shiny account on multiple devices via Google Play and Apple App Store.
• Notifications & Alerts - Set up personalized alerts for price changes, market trends, and new cards or sets that match your interests.
• Community Features - User profiles, commenting, and rating systems to build trust and communication among collectors.

We reserve the right to modify, enhance, or discontinue any features at any time without notice.

Your Account

• To use certain features, you need to create an account.
• You're responsible for keeping your login credentials confidential.
• Make sure your account info is accurate and up to date.
• We're not responsible for unauthorized access to your account.
• You may not share, transfer, or sell your account to another person.

Rules of the Road

Here's what we expect from everyone who uses Shiny:

Things You Can't Do

• Use Shiny for anything illegal, fraudulent, or unauthorized.
• Harass, threaten, bully, or discriminate against other users.
• Hack, reverse engineer, or disrupt the App's functionality, servers, or databases. This includes using bots, scrapers, or other automated tools to collect data or interfere with the service.
• Impersonate any person, entity, or misrepresent your affiliation with someone else.
• Upload viruses, malware, or any malicious code.
• Spam, post unauthorized ads, or share commercial content unrelated to trading cards.

Your Content

• You're responsible for everything you post on Shiny, including images, descriptions, and messages.
• We don't pre-screen content, but we can remove anything that violates these Terms.
• By posting content, you grant Shiny Cardboard LLC a non-exclusive, worldwide, royalty-free license to display and distribute it within the App and Site.

Community Standards

• Treat other users with respect.
• Bullying, harassment, or malicious behavior may result in account suspension or termination.
• You can report inappropriate behavior or fraud, and we'll review reports at our discretion.
• Content you share in public areas (profiles, comments, etc.) is visible to others. By posting it, you agree to interact respectfully and take responsibility for what you share.

Enforcement

• We reserve the right to monitor activity to ensure compliance with these guidelines.
• Violations may result in temporary or permanent suspension, and complete removal of account data with or without your permission.
• We may take legal action if unlawful activity occurs through the App.

Catalog Data and Collection Export

Our Trading Card Catalog

Shiny Cardboard LLC maintains a proprietary trading card catalog, including card identifiers, names, attributes, classifications, pricing references, metadata, and the overall organization of that data (the "Catalog Data"). This catalog is developed and maintained at substantial cost and is our proprietary business information. All rights to the Catalog Data belong exclusively to Shiny.

Your Collection Data

Your collection records ("Collection Data") reference and incorporate Catalog Data, including Shiny-assigned identifiers and metadata, in order to work within the platform. The fact that Catalog Data appears in your Collection Data does not transfer any ownership or usage rights in the Catalog Data to you beyond what's described here.

Export for Personal Use Only

We may let you export your Collection Data for personal backup, archival, or continuity purposes. This does not give you the right to extract, reuse, reconstitute, or redistribute the Catalog Data in any form.

What You Can't Do with Exported Data

You may not use exported Collection Data (including any embedded Catalog Data) to:

• Populate, seed, enhance, or operate any competing catalog, collection manager, marketplace, or related service.
• Migrate, recreate, or map Shiny's Catalog Data into a third-party platform.
• Help another service substitute for or compete with Shiny's catalog, database, or platform.

You also may not upload, import, or provide exported data to any third party for competitive purposes, or help anyone else do so. Attempting to bypass any technical or contractual protections around Catalog Data is also prohibited.

If You Break These Rules

Unauthorized use of exported Collection Data or Catalog Data is a material breach of these Terms and may result in suspension or termination. We reserve all legal remedies available, including claims for breach of contract, misappropriation, unfair competition, and injunctive relief.

Subscriptions & Lifetime Access

Subscriptions to Shiny, including Shiny Pro, are managed through the Apple App Store and Google Play Store. All billing, cancellations, and refund requests go through the store where you made your purchase.

For lifetime license holders, "lifetime" means as long as the Shiny application continues to exist under its current name. Lifetime access does not guarantee the app will be available forever, and it ends if Shiny is discontinued, materially changed (meaning it no longer focuses on trading card collection tracking as part of its core purpose), or replaced under a different name.

Shiny Pro access (including lifetime) may be revoked, rate-limited, throttled, or discontinued at our discretion, including for misuse, Terms violations, technical limitations, or any other reason we see fit.

Features described as "unlimited" mean there's no predetermined fixed limit under normal personal use. They're still subject to fair use, technical limits, and cost considerations. We may restrict usage if it materially exceeds what we consider reasonable, or if it impacts the service for others.

Card Scanning

Card scanning is included with Shiny Pro and lifetime licenses and is marketed as "unlimited." That means no fixed scan limit under normal personal use, but it's still subject to fair use. We may rate-limit, throttle, or restrict scanning if usage goes beyond what we consider reasonable, or if it impacts service performance. Unlimited access doesn't mean unconstrained access, and we reserve the right to modify, suspend, or discontinue scanning features as needed. Shiny is not intended for business operations.

Privacy

Your privacy matters to us. Check out our Privacy Policy to understand how we collect, use, and protect your information.

Intellectual Property

• Shiny and all associated content, trademarks, and intellectual property belong to Shiny Cardboard LLC.
• Trading card images, names, and associated content displayed in the App are the property of their respective owners and are used for identification and informational purposes only.
• You may not copy, modify, or distribute any part of the App without our written permission.

Termination

We can suspend, disable, or terminate your access to Shiny at our discretion, including if you violate these Terms.

Disclaimers and Liability

• Shiny is provided "as is" and "as available." We make no warranties about accuracy, reliability, or availability.
• Market data and pricing in the App is for informational and research purposes only. It's not investment advice, financial advice, or a recommendation to buy or sell.
• Market values change, and we don't guarantee the accuracy, timeliness, or completeness of pricing data.
• You're responsible for any collecting or purchasing decisions you make based on info in the App.
• We're not responsible for losses or damages from your reliance on market data in the App.
• To the maximum extent permitted by law, our liability is limited to the amount you've paid to use the App (if any).

Indemnification

You agree to indemnify and hold harmless Shiny Cardboard LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the App, your content, or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the United States and the state of Nevada, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms at any time to reflect changes in our services, business practices, or legal requirements. Updates take effect immediately when posted in the App or on the Site. For major changes, we'll give you a heads up via in-app notification, email, or other reasonable means.

Continuing to use Shiny after changes are posted means you accept the updated Terms. If you don't agree, stop using Shiny.

Changes may include updates to user rights, subscription policies, acceptable use guidelines, or feature availability.
